What is a "Direct" Will or Trust Contest?
Under Probate Code §21300(b), a "direct contest" of a will or trust is a court proceeding alleging the invalidity of an instrument (or one or more of its terms) based on any of the following grounds:
• revocation;
• lack of capacity;
• fraud;
• misrepresentation;
• menace;
• duress;
• undue influence;
• mistake;
• lack of due execution; and/or
• forgery.
