Has A Loved One Been Neglected or Abused By a Nursing Home?
California has a strong set of laws designed to protect the elderly or the infirm from neglect or abuse by Nursing Homes or Long Term Care Facilities. The law provides for damages and an award of attorney's fees in cases for Elder or Dependent abuse or neglect. Under Welfare and Institutions Code Section 15610.07, "abuse of an elder or a dependent adult" means either of the following:
(a) Physical abuse, neglect, financial abuse, abandonment, isolation, abduction, or other treatment with resulting physical harm or pain or mental suffering.
(b) The deprivation by a care custodian of goods or services that are necessary to avoid physical harm or mental suffering.
