I Think the Trustee of Our Family Trust Is Engaging in Misconduct, What Can Be Done?

A Trustee if a person who has the legal right to manage and control the property of another, for the benefit of one or more beneficiaries.  Often times, Trustees are not professionals or trained for the task, they are simply family members who were selected by an elderly or deceased parent.  Trustees may be tempted to take action that is not in the best interests of the beneficiaries, such as make speculative investments, or to even engage in fraud or embezzlement of trust assets.  When this happens, beneficiaries may have the legal right to obtain a order from a court disqualifying the Trustee, and sue the Trustee to recovery misappropriated Trust assets, or damages.
