Putting aside whether or not these medical implants represent serious health risk, there can be little doubt that they fail to meet the reasonable expectations of physicians and patients who relied upon the manufacturer. Under well established rules of law, when a product is designed or manufactured in a manner that fails to adhere to applicable standards of care, consumers of the product are entitled to legal recourse, which in this type of case may include the costs of replacement surgery, as well as compensation for pain and suffering, lost income, and losses associated with activities that are normally associated with a properly performing prosthetic device.
