Insurance Disputes

Insurance companies owe their customers a Duty to Act Fairly and In Good Faith. When an insurance company breaches this duty by refusing to pay on a legitimate claim, it may be held liable for the Wrongful Denial of an Insurance Claim. Insurance Bad Faith can also occur when an insurance company Fails to Conduct a Reasonable Investigation after a claim has been submitted. The requirement that an insurance company must treat its insureds fairly applies to all types of insurance policies, including Life Insurance, Medical and Health Insurance, Automobile, Aircraft and Water Craft Insurance, Disability Insurance, Property and Casualty Insurance, Business Premises Insurance, Homeowners Insurance and Legal Liability Insurance. The Damages that can be obtained in an Insurance Bad Faith case include the full value of the Policy Benefits, and if the insured has suffered other types of harm due to the denial of the claim, it may be possible to recover Consequential Damages or Emotional Distress Damages. When an insurance company engages in a Pattern of Bad Faith, through the Routine Denial of Legitimate Claims, or the Habitual Failure to Reasonably Investigate Claims, the insurance company may be liable for Punitive Damages. When an insurance company Wrongfully Refuses to Defend or Reasonably Settle lawsuit claims made against an insured under a Legal Liability Policy, the Damages that can be recovered include not only the Coverage Limits of the Liability Policy, but also may cover any amount awarded at trial against the insured in Excess of the Policy Limits when a Policy Limits Settlement Demand has been made prior to trial.

Our firm also serves as independent attorneys for people who have been sued, when their insurance companies have issued a reservation of rights letter in the capacity of Cumis Counsel.

In addition to representing individuals and businesses in claims against insurance companies for bad faith, our firm represents clients in the process of negotiating with insurance companies in order to achieve a fair resolution of pending claims.  If you have had an insured loss and are in the process of working with an adjuster to resolve a claim, feel free to contact us if you are concerned that you are being treated unfairly by the adjuster or if the settlement offers made by the insurance company will not fairly compensate you.
